I was told this when Moms name was on my nephews account. The lawyer doing Moms Will and POA told us to take her name off the account. As her POA and his I was able to do this and then put my name on his account. It was explained anything with Moms name on it would be considered her money. You would need to prove that it wasn't. Yes, at 77 I am going to need to remove my name eventually.

I'm confused why anyone would think Medicaid or anyone else wouldn't consider it all his? If the only income going in is his, it IS all his.

Yes, the headline acted as if something was wrong with the state counting it all as his, when in fact that was correct.

Thanks for sharing this article.
The one thing that stuck out to me was the following: "the family assumes joint title means the state will count only half." If the family was assuming this, it seems that the family was hoping to evade Medicaid divestment rules. It's good to know that the proper result was reached: The father's assets will be used for his care before taxpayer dollars are used.
